COMMUNITY GUIDELINES

These Community Guidelines (“Community Guidelines”) apply to your access and use of online services provided by Adventure Soup Inc. (“Picsaurus”, “we”, “us” or “our”) and is hereby incorporated into and forms part of the Picsaurus Terms of Service (“Terms”). Violations of the Community Guidelines may result in enforcement actions described in the Terms, including suspension or permanent removal of your Account. Capitalized terms not otherwise defined herein have those meanings ascribed to them under the Terms.

BY EXECUTING AN AGREEMENT THAT REFERENCES THESE COMMUNITY STANDARDS, BY CLICKING I AGREE” OR SIMILAR CONFIRMATION, OR BY USING THE SERVICE YOU ARE AGREEING TO BE BOUND BY THESE COMMUNITY STANDARDS.

1. USER RESPONSBILITIES AND ACCOUNTABILITY

1.1 User Responsibilities. When using the Service, you are responsible for all activity that occurs under your Account or that you conduct from your own electronic devices. Use of the Service requires that you: (a) comply with all applicable laws and regulations; (b) do not harm, exploit, manipulate, endanger, or deceive other users or otherwise attempt to do any of the preceding; (c) do not interfere with Picsaurus staff, systems, moderation processes, or legal investigations; (d) do not create, maintain or use more than one Account or Profile (unless Picsaurus expressly grants permission); and (e) only use the Services for lawful purposes and in compliance with these Community Guidelines and the Terms at all times.

1.2 Accuracy and Accountability. All users (Guests, Operators and Guides) are required to provide truthful, complete, and accurate information when registering an Account or Profile or generally using the Service. All users are expressly prohibited from: (a) uploading content of other persons in private settings without their consent; and/or (b) uploading content that is intended to mislead. In certain circumstances, Operators may permit photos to be taken and shared pursuant to written waivers or other agreements provided directly by the Operator. If you are unsure of whether or not you may upload content featuring another person, please confirm with the relevant Operator. If Picsaurus suspects you are failing to comply with these accuracy and accountability requirements, we may remove postings or issue warnings. Failure to comply with the warnings or upload restrictions may result in suspension or removal. 

2. CONTENT AND INTERACTIONS

2.1 Content Restrictions. Users are responsible for all content they upload to the Service and are restricted from uploading any inappropriate, offensive, obscene and/or illegal content. Examples of prohibited content and behaviour includes but is not limited to: 

  • Pornography, sexually explicit imagery and videos; 
  • Photographic, videographic, or illustrated nudity that displays genitals or otherwise depicts sexual activity (unless there is a clear educational, humorous, or satirical artistic purpose for such depiction); 
  • Content portraying excessively graphic violence and/or gore; 
  • Content that is harmful to minors and minority or protected groups, including photos and sexualized content of minors, abusive or illegal content, hate speech, hate symbols and/or extremist references;
  • Content that is contrary the Operator’s rules, policies and/or guidelines for content, media and other uploads (where applicable);
  • Other generally inappropriate, inaccurate or offensive content; and
  • Any content that you do not have adequate right, title and interest in, including intellectual property, privacy and publicity rights required to share such content publicly and/or claim authorship thereof,

as determined in Picsaurus’ sole and absolute discretion. 

Picsaurus and/or the Operator may monitor and moderate content through a multi-layer moderation system. Picsaurus’ users may (where the feature is implemented) report violations of the Community Guidelines and provide evidence to law enforcement where a user’s actions violate applicable laws. If you have any questions about what content and/or behaviour may violate the Community Guidelines (for example, whether nudity included in certain artworks may be permitted), you are encouraged to contact us at support@picsaurus.com and confirm whether or not such content is permitted prior to uploading it on the Service.

2.1 Communication. All users must communicate respectfully and avoid hostile or abusive behavior. In the event you are granted access to any comment functionality, you are only permitted to communicate appropriately and respectfully. Prohibited behaviors include but are not limited to: (a) spamming or mass-copying messages; (b) harassment or targeted insults; (c) bullying or belittling of others, including encouragement of self-harm or violence; (d) hate speech of any form; (e) threats, intimidation, or coercion; (f) stalking and intimidation; and (g) pressuring users into meeting or talking. Users are expected to conduct themselves politely, respectfully and to stop communicating with another user if asked. You may report users where you believe they have failed to comply with the Community Guidelines or the Terms. 

3. REPORTING & ENFORCEMENT

 3.1 Reporting Capabilities. The Service may be equipped with reporting and other restriction features. Picsaurus strongly encourages all users to report any suspected violations of the Community Guidelines, the Terms and other suspicious behaviour, including but not limited to harassment, scams, fake profiles, and other dangerous and/or threatening behaviours. All reports are taken seriously and extensively reviewed by Picsaurus through both automated and manual review processes. Where required to investigate a report, Picsaurus may internally log safety-related interactions (which are collected, processed and stored in accordance with our Privacy Policy). Picsaurus reserves the right to act on any reports submitted by users, and take all enforcement actions prescribed within this Code, the Terms or otherwise permitted by applicable laws. 

3.2 Enforcement and Penalties. In addition to those enforcement actions provided under the Terms, Picsaurus reserves the right to enforce these Community Guidelines, the Terms and applicable laws and regulations through various means. Where Picsaurus discovers a user has violated any of the above, we may: (a) issue a warning notice; (b) remove, restrict or hide violating content/listing(s); (c) impose temporary restrictions on your Account, including suspending your Account; (d) require mandatory verification of your identity; (e) permanently ban your Account; (f) continuously monitor your Account for further violations; (g) report your actions to law enforcement and otherwise cooperate with law enforcement or government investigations; and/or (h) take any other actions reasonably necessary to enforce our technical, contractual or legal obligations. Also note that Operator’s may directly remove, restrict or hide violating content if they believe it violates the Terms, or any other agreement, rules or policies imposed by the Operator. If your actions constitute a significant risk to user safety, community integrity or legal requirements, Picsaurus may enforce a penalty without prior warning or notice to you. Picsaurus enforcement decisions and penalties are final unless otherwise stated by Picsaurus in writing. In limited circumstances, you may appeal an enforcement decision by contacting Picsaurus via email at support@picsaurus.com with a description of your appeal. Picsaurus may refuse to hear an appeal, with or without notice to you, at its sole and absolute discretion. 

4. UPDATES

Picsaurus reserves the right, in its sole discretion, to modify these Community Guidelines at any time (each, an “Update”) and may do so without prior notice to you. Picsaurus shall make each Update available to you through the Website and/or through email notification. You are deemed to accept an Update by continuing to use the Service.
